House to appeal SC ruling on VP Duterte impeachment

The House of Representatives on Sunday said it will file a motion for reconsideration before the Supreme Court (SC) on its ruling that the fourth impeachment complaint filed against Vice President Sara Duterte was unconstitutional.

House Spokesperson Princess Abante said the lower chamber will raise that “the SC ruling was anchored on findings that contradict the official record of the chamber.”

Abante said that the House voted to archive the three complaints hours before adjournment the same day it endorsed the fourth complaint to the Senate for trial.

The House spokesperson added that SC’s decision that the House violated the one-year ban was based on “factual and procedural inversion” and “one news article” instead of House journals and official reports.

She added that the narrative that the Articles of Impeachment were transmitted to the Senate without plenary approval was “categorically false,” as the complaint was verified by more than one-third of the members of the House.

Abante also said that SC’s assertion that Duterte should have been given the chance to be heard on the Articles of Impeachment before it was transmitted to the Senate, even with the vote of more than one-third of the House, was not written in the Constitution or the Rules of Congress.

Abante further argued the court’s ruling added “very stringent requirements” that “encroach on the exclusive powers of the House.”

She also said that Duterte was repeatedly invited to the House hearings to present her side.

Last July, the Supreme Court ruled that the Articles of Impeachment against Duterte violated the constitutional provision that only one impeachment complaint may be initiated against an individual per year, saying that “it violates the right to due process enshrined in the Bill of Rights.”

The High Court cited the first three complaints filed against the vice president in December 2024 before the fourth complaint the House acted upon, leading to Duterte’s impeachment in February.

Meanwhile, the Duterte camp said it is on “wait and see” mode, ready to oppose or give comment when the House files its motion for reconsideration.
